Contested Divorce
Obtaining a divorce can be an emotionally difficult procedure, especially if your spouse is not willing to cooperate in filing for the divorce and resolving all of the issues associated with it. If this is the case, you will be asking the Court to determine many of the issues involved in your separation and contested divorce, including division of marital assets, spousal and child support, and child custody and visitation. While many of the procedures are similar to those for a non-contested divorce, there are additional steps that make it a lengthier and more difficult process.
There are six grounds for divorce in Virginia: adultery, cruelty, abandonment, felony conviction, one-year separation, and six-month separation (only possible if there are no minor children and the spouses have signed a written property and support settlement agreement). The first four are the most common reasons for a contested divorce.
